On June 23, 2020, former clients obtained a six-figure default judgment against Dirksen's company, Evolve Building, for breach of a settlement agreement.
According to the Complaint, plaintiffs fired Dirksen and his company after discovering that he had failed to obtain a single permit, retain any subcontractors or perform any renovations on the property after over six months "on the job".
Dirksen kept the plaintiffs' entire security deposit, even though the contract unambiguously stated that the deposit was only for purchasing materials (which Dirksen would not release to the plaintiffs, even though he had paid for it out of their deposit) and that Dirksen/Evolve would only be paid for renovations that were actually performed.
Dirksen eventually agreed to refund their deposit, but then reneged on that settlement agreement.
